FUNDING

FDC, through a dedicated special purpose vehicle (SPV), acquires the right (Claim) and bears all costs and risks associated with its monetisation. In the event of a successful outcome, the proceeds recovered are distributed to the client, net of a predetermined success fee.

CASH-OUT

Also through an SPV, FDC purchases the right and pays the client an immediate, final amount on a non-recourse basis. From that point on, FDC independently manages the litigation and the monetisation process.

In both solutions, representation in proceedings is preferably entrusted to the law firm already engaged by the client, ensuring operational continuity and leveraging existing professional relationships.

The analysis and assessment of Claims for acquisition purposes, as well as their subsequent management, are handled by the commercial team during the preliminary analysis phase and by the legal team for the in-depth assessment.
The analysis procedures adopted by Libra – FDC enable extremely prompt feedback, whether the outcome is non-eligibility of the Claim or a positive approval.
