PFAS Contamination: the Miteni Case

From claim registration to collective redress action

The Risarcimento Miteni campaign was established to enable those affected by PFAS contamination in central-western Veneto to assert their potential right to compensation, without having to bear upfront costs or individually face the financial and legal risks of complex litigation.

For over forty years, the Miteni plant in Trissino discharged toxic chemical substances — known as PFAS — into the groundwater. The contamination affected areas of Veneto across the provinces of Vicenza, Verona and Padua, involving red, orange and blue zones at varying levels of severity.

Exposure to PFAS may give rise to a compensable claim even in the absence of evident symptoms. Assessing each individual’s position therefore requires a structured collection of personal, medical and financial data, documents and information, necessary for the accurate profiling of each claimant.

The initiative is open to individuals who lived or worked in the PFAS-contaminated areas and who, depending on their personal, family and financial circumstances, may have suffered a recoverable loss.

Eligible situations include having resided in the contaminated zones from 1996 onwards, even if no longer living there today; having worked in those areas; having owned residential or agricultural property purchased before 2016; and, in the most serious cases, having lost a family member to illnesses potentially linked to PFAS exposure.

Libra – FDC provides a funded collective action model: legal, technical, expert and organisational costs are advanced by the initiative’s promoter. Participants are not required to contribute any upfront amount; only upon successful recovery of compensation will a percentage of the sum obtained be recognised.

Current Campaign Status

The registration phase has now closed, and the process has moved into the contractualisation and document collection stage. This phase is essential to accurately complete each participant’s profile, verify the grounds for their claim, and enable the personalised calculation of recoverable damages.

Each participant may complete the contractualisation process either through the personal link they have received or by visiting one of the Registration Points open across the territory, where dedicated staff provide assistance with completing the questionnaire, signing the agreement, and submitting the required documentation.

The collective action will be initiated as soon as all participants have completed the contractualisation process and provided the necessary documentation.

Come funziona il percorso

The participant formalises the contractual relationship through the link received or at a Registration Point.

The documents and information required to reconstruct each claimant’s personal, employment, medical and financial history are gathered.

The legal, technical and medical team analyses each individual’s position to identify the heads of damage potentially eligible for compensation.

The compensation claim is built on the basis of each participant’s specific circumstances.

The proceedings will be initiated upon completion of the contractualisation and document collection process for all participants.

For participants, the immediate priority is to complete their own position: only a thorough and well-organised submission of information allows a compensation claim to be prepared that accurately reflects the damages actually suffered.
