Case Summary

Decision I864, although still subject to appeal, already opens the possibility for those harmed by the cartel to pursue a compensation claim for fuel purchased during the relevant period.

Libra – FdC SpA offers companies operating vehicle fleets (lorries, buses, vans, heavy machinery and passenger cars) that purchased automotive diesel fuel anywhere in Italy the exceptional opportunity to join a funded collective action — similar to a class action — seeking compensation for damages suffered.

Participants in the Libra – FdC SpA campaign will be able to assign their potential compensation claim, along with the burden of pursuing proceedings against the sanctioned parties, without bearing any costs or legal risk. Only upon successful recovery will a percentage of the amount actually obtained be retained.

The campaign will be open from 1 March 2025 until the available funding allocation is exhausted.

On 26 September 2025, the Italian Competition Authority (AGCM) issued Decision I864, establishing the existence of a competition-restricting agreement among the leading oil industry operators.

The AGCM sanctioned the companies ENI, Esso Italiana, IP, Q8, Saras and Tamoil for having infringed antitrust regulations for over three years, from 1 January 2020 to 30 June 2023, through a coordinated arrangement aimed at determining and artificially inflating the value of the “bio” component of fuel — the portion of the cost linked to biofuel blending obligations. Over the course of the sanctioned period, the value of the bio component is reported to have risen from approximately €20/m³ (estimated value in 2019) to approximately €60/m³ in 2023.

The aforementioned oil companies were fined a combined total of €936,659,087.
